By using Canary, you agree to these Terms of Service. Read carefully. These terms include important information about your rights, obligations, and limitations of liability.
These Terms of Service ("Terms") govern your use of Canary's messaging protocol, token services, NFT marketplace, and node network operated by Boobies Interactive LLC ("Canary", "we", "us", "our"). By accessing or using Canary through our website, mobile apps, or APIs, you agree to be bound by these Terms and our Privacy Policy.
If you don't agree to these Terms, do not use Canary.
You must meet these requirements to use Canary:
Canary provides end-to-end encrypted messaging infrastructure on Solana. We route messages but cannot read message content. You are responsible for safeguarding your encryption keys.
Create password-protected token gifts for others to claim. Gifts expire after 90 days if unclaimed. We act as a custodian during the gift period but are not liable for failed transactions or lost funds.
List NFTs with buyback offers. Buyers and sellers interact directly; Canary facilitates escrow but is not a party to transactions. We are not responsible for NFT authenticity or value fluctuations.
Partners can apply to distribute tokens to Canary users. Applications are reviewed manually. Approval is at our sole discretion. Partners must comply with token securities laws in their jurisdiction.
Run nodes to earn CANARY token rewards. Node operators must maintain uptime and bandwidth requirements. We reserve the right to suspend nodes for abuse or poor performance.
⚠️ CRITICAL: You are solely responsible for your wallet private keys. Canary NEVER asks for your private keys. We cannot recover lost keys or reverse transactions. Loss of private keys means permanent loss of access to your funds.
Solana blockchain transactions require network fees ("gas"). These fees go to Solana validators, not Canary. Fees are subject to network congestion and outside our control.
Blockchain transactions are irreversible. Once confirmed on Solana, transactions cannot be undone. Verify all details before confirming.

Canary and its logos, trademarks, designs, and software are owned by Boobies Interactive LLC. All rights reserved. You may not use our branding without written permission.
You retain ownership of your messages, NFTs, and other content. By using Canary, you grant us a limited license to:
We do not claim ownership of your content. Our license ends when you delete content or stop using Canary.
Certain Canary components may be open-sourced under MIT or Apache licenses. Check our GitHub for details. Open-source code is provided "as is" without warranty.

You can stop using Canary anytime. Your blockchain data remains on Solana (we can't delete it). Request off-chain data deletion via privacy@canarymessenger.com.
We may suspend or terminate your access immediately without notice if you:

Canary does not currently require KYC for basic usage. We reserve the right to implement KYC if required by law or for high-value transactions.
We prohibit money laundering and comply with AML regulations. Suspicious activity may be reported to authorities.
CANARY tokens are utility tokens for network rewards, not securities. However, partners distributing tokens must ensure compliance with securities laws in their jurisdiction.
You may not use Canary if you're on OFAC sanctions lists or located in embargoed countries (e.g., North Korea, Iran, Syria, Crimea).
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
Any disputes will be resolved through binding arbitration under AAA rules, rather than in court. Arbitration is conducted individually (no class actions).
Either party may seek injunctive relief in court for intellectual property violations or urgent security matters.

Continued use after changes constitutes acceptance. If you don't agree, stop using Canary.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Boobies Interactive LLC.
If any provision is found unenforceable, the remaining provisions remain in effect.
Our failure to enforce any right or provision doesn't constitute a waiver of that right.
You may not transfer these Terms to anyone else. We may assign our rights to affiliates or acquirers.
We're not liable for delays or failures caused by events beyond our reasonable control (natural disasters, war, cyber attacks, network outages).
